Update: Prosecutors Yet to Determine If They’ll Seek Death Penalty for Keith
Keith may have to wait more than a year for his day in court.
On Monday Judge Darren Peckler denied bond to Keith, citing that this is a capital case.
Keith’s attorney Mark Stanziano says he was surprised that the judge denied any kind of bond, since the State has not yet said they will pursue the death penalty.
Commonwealth’s Attorney Richie Bottoms says that this case is eligible for the death penalty, which is why he thinks the judge denied bond. Bottoms added that as of Monday, they had not filed papers to pursue the death penalty.
Bottoms says they are still going over evidence and says family of the victims will have a say in whether to pursue the death penalty.
Bottoms expects a trial date to be set by the Spring or early Summer of 2014.
Keith is due back in court for a status hearing on February 4th.
