UK student, fraternity suspended after fatal DUI accident

LEXINGTON, Ky. (WTVQ) – The University of Kentucky has suspended a student accused of causing the death of a 4-year-old child.

The Associated Press says UK President Eli Capilouto sent a letter to the campus on Tuesday, saying 18-year-old Jacob Heil and the fraternity he pledged, Alpha Tau Omega, were suspended pending investigation.

Heil is accused of being under the influence when he hit Marco Lee Shemwell near Kroger Field during Kentucky’s game against Murray State Saturday.

Shemwell died from his injuries at Kentucky Children’s Hospital Monday afternoon.

According to a police report, Heil told police he was leaving a tailgating party where he says he drank two beers several hours before the accident.

Documents say Heil had a blood alcohol level of .051, over the legal limit for people younger than 21.

Heil was charged with driving under the influence.

He is scheduled to make his first court appearance on Wednesday.
