Negligence suit filed after fatal Clark Co. fire

WINCHESTER, Ky. (WTVQ) – A lawsuit has been filed in Clark Co. by a former resident of B & P Apartments in connection to a fatal fire at the complex.

The lawsuit, filed by Eric Everman, cites negligence on the part of the B & P Apartment, along with former resident Jackie Hisle, the man charged with manslaughter in connection to the fire at the apartments on March 11 that left three people dead and several families displaced.

The suit claims Hisle was negligent in storing and using oxygen in his apartment, and smoking around the flammable material.  Winchester Police Sgt. Tom Beall has testified that Hisle told him that he was intoxicated and smoking while using his oxygen machine.  Reportedly, the fatal fire began when the oxygen line caught on fire.

The lawsuit also alleges that B & P Apartments was negligent in creating a safe and hazard-free environment for residents.  The suit claims Everman suffered distress and injury when he was forced to jump from his second-floor apartment to escape the flames.  He also had to assist his elderly mother in escaping the fire.
