Law professor: some county clerks aren’t doing their job
Governor Steve Beshear met with Casey Davis, the clerk in Casey County. He’s one of the clerk’s refusing to issue marriage licenses since the high court’s decision.
After the meeting, David said the Governor told him to obey the law or resign. Davis said he wouldn’t quit and vowed to go to jail before he issued any licenses.
The Governor’s office says it has received letter from a few county clerks asking for a Special Session of the Kentucky General Assembly to discuss clerk’s religious freedoms. Governor Beshear says he does not plan to call one.
When elected officials, including the county clerks, were elected they took an oath to uphold the U.S. Constitution, which now says same-sex marriage is legal. One job of a county clerk is to issue a marriage license.
So if a county clerk isn’t doing his or her job, what happens? Watch the video to find out what a University of Kentucky College of Law professor says.
