Jury awards $18 million to child hurt in delivery

GLASGOW, Ky. (AP) — A southern Kentucky jury has awarded more than $18 million to a child who suffered brain damage while being delivered at T.J. Samson Community Hospital.

Ten of 12 jurors concluded that the hospital acted negligently and deviated from the accepted standard of care for Tristan Hamilton.

Tristan was injured during delivery in 2007, suffering a brain injury and other persistent health issues. The child, through his mother, Brittney Hamilton, both of Bowling Green, filed a lawsuit in 2011 against the hospital and Kelly Dirig, the obstetrician-gynecologist who delivered Tristan.

The jury cleared Dirig of any liability in its verdict.

Plaintiff’s attorney Tyler Thompson told the Daily News (http://bit.ly/1toFIw8) the jury did well in understanding the case.

A hospital spokesman did not immediately say if the verdict would be appealed.
