Family sues school district over disabled son’s education
LEXINGTON, Ky. (WTVQ) – It may may be one of the first in what some experts say could be a wave of the future in the courts, families saying school districts did not fulfill individual education plans for their special needs child during the pandemic (school lawsuit2).
The family of a Tates Creek High School student who has attended Fayette County schools throughout his career except for one year has sued the school district alleging the district didn’t accommodate their disabled son with non-traditional instruction.
The suit originally was filed in Fayette Circuit Court and then moved to federal court.
The family is seeking damages for their son as well as embarrassment and humiliation.
The district has denied the family’s claims and asked a judge to dismiss the lawsuit (school lawsuit answer).
