Clark County Neighbors Sue Over Zone Change

A group in Southern Clark County isn’t happy that some rural farm land has been rezoned for heavy industry so they filed a lawsuit.

The Southwest Clark Neighborhood Association is not happy that the Clark County Fiscal Court switched 165 acres of farm land to be zoned for heavy industrial use.

They want the Clark County Circuit Court to overturn the Fiscal Court’s re-zoning so the land will stay farmland.

The Allen Company, which owns a quarry in Madison County, is trying to expand across the Kentucky River into Clark County.

It wants to turn the 165 acres into an underground limestone mine but the first the land needed to be rezoned.

The Planning and Zoning Commission voted six to one against rezoning but the Fiscal Court voted three to one to rezone the land for heavy industrial use.
 
People who live nearby said they don’t have a problem with the quarry but they said the rezoning goes against Clark County’s five-year, comprehensive plan.
 
The county and the Allen Company have 20 days to respond to the complaint.
 
ABC 36 reached out to the county and the Allen Company but have not heard back.
