CentrePointe developers threaten legal action against city

LEXINGTON, Ky. (WTVQ) – The latest in a week filled with claims and counter-claims by the city of Lexington and the developers of the CentrePointe project downtown, comes a letter from developer Dudley Webb’s attorney to the city on Friday.

The letter, from attorney Richard A. Getty, threatens legal action if the city doesn’t rescind by May 8, 2015, its request that the developers fill-in the project site and return it to its original grassy field.

In the letter, the developer claims that city leaders, led by Mayor Jim Gray, are intent on destroying the project.  On Tuesday, April 28, 2015, the city sent a letter to the CentrePointe developers demanding the construction site be filled-in.  The city cited a December 2013 agreement between the city and the developers that said if there wasn’t any work done on the construction site for 60-consecutive days, the developers would fill it in and return it to its original state.

The next day the developers fired back with a letter to the city claiming work had been done within the last two months and cited specific dates and the type of work performed at the site.  On Thursday, developer Dudley Webb went before the Urban County Council at its regularly scheduled meeting and expressed his disappointment with the city and the way it handled what he felt were unfounded claims. 

On Friday, another letter from the developers to the city with the May deadline and threatened lawsuit.  As of this writing, the city had not responded to the most recent letter from the developers.  Also on Friday, Dudley Webb told ABC 36 News by phone that he hoped something could be worked out to avoid going to court.

The often delayed project has been going on for seven years.  So far, all that’s on the construction site is a hole in the ground for an underground parking garage.  The plan also includes a hotel, office building, apartments and retail space.
