Smucker’s sues Trader Joe’s over alleged Uncrustables copycat sandwich
(ABC36 NEWS NOW) – Smucker’s is suing Trader Joe’s, claiming the grocery chain copied its popular Uncrustables sandwiches with a nearly identical product.
The J.M. Smucker Company filed the lawsuit over Trader Joe’s “Crustless Peanut Butter & Strawberry Jam Sandwiches,” alleging the product violates trademarks tied to Uncrustables’ design and packaging. The suit specifically points to the sandwiches’ circular shape and the signature crimped edges.
Smucker also accuses Trader Joe’s of using similar packaging imagery — including a sandwich with a bite taken out, revealing the filling — which Smucker says is a protected trademark.
The company is asking the court to order Trader Joe’s to stop producing the sandwiches, destroy remaining inventory, turn over profits from sales, and pay additional damages.
