No charges initially filed following shooting in Breathitt County
LOST CREEK, Ky. (WTVQ) – A Breathitt County Grand Jury will decide if any criminal charges should be brought against 41-year old James Henry White, who Kentucky State Police say shot 37-year old Matthew White, of Lost Creek, for allegedly trying to break-in to a home.
KSP says it happened on Sunday, August 1, 2021, shortly before 9:00 p.m. on Upper River Caney Road in the Lost Creek community.
Investigators say James Henry White saw Matthew White and several other people trying to get into a home on Upper River Caney Road.
State Police say James Henry White told the people to leave the area, went inside his home, got a gun and when he saw the people still trying to get into the home, he fired several shots in the direction of the people, hitting Matthew White.
Investigators say Matthew White suffered non-life threatening injuries. He was taken to U.K. Hospital in Lexington.
KSP says no initial charges were filed in the case. It will be up to the grand jury to decide if charges should be filed.
KSP Detective Clayton Stamper is leading the investigation.
