Murder case against Jordan Witt to be heard by grand jury
ANDERSON COUNTY, Ky. (WTVQ) — A Lawrenceburg woman charged with murder in her boyfriend’s shooting death, claiming it was an accident, was in court Thursday.
18-year-old Jordan Witt is accused of killing 19-year-old Kyle York after State Police say she pulled the trigger.
On April 13th, State Police found York shot in the head. He was taken to the hospital where he died.
“He had a huge life ahead of him and he was very loving and he touched so many lives,” says York’s big sister, Shawna. “And he had a huge, huge future ahead of him and that was taken away.”
Witt’s attorney says the whole thing was just an accident.
A detective testified that Witt claims she thought the gun she picked up was a BB gun, since both the pistol and BB gun were side by side.
He says both guns looked different.
“The revolver was picked up by Miss Witt, pointed to the head, center of the head between his eyes. The trigger was pulled resulting in him being shot,” says the KSP detective testifying.
The detective says witnesses said Witt picked up the pistol and asked if it was real and York told her yes.
He says she then started swinging the gun around, ultimately pointing it to York’s head.
Prior to that, the detectives were told both York and Witt were playing with the guns.
State Police say they believe Witt was under the influence of drugs that night.
Both drugs and alcohol were found at the scene.
They’re waiting on lab results.
“I think it’s very blatantly obvious that she was told what was fake and what was real and she still chose to make the decision as to whether she put the fake or the real against his head,” says big sister, Shawna York.
KSP had previously said Witt didn’t intend to kill York.
“I mean it’s a horribly sad case even the police officer testified that at this point it looks like an accident and so we don’t usually lock people up for accidents,” says Witt’s attorney, Brent Cox.
The judge found probable cause and the case was waived to the grand jury to decide whether to indict Witt on the wanton murder charge, or not.
Shawna York says she wants the maximum sentence for Witt.
“I want to be there for Kyle,” says York. “I want to stand up for Kyle. Because when Jordan pulled that trigger, she took that voice from my brother. So now I’ll be the voice for my brother.”
Witt remains in jail on a $500,000 bond.
