Lincoln Co. BOE attorney: Bullying lawsuit should be dismissed

STANFORD, Ky. (WTVQ) – A Lexington attorney representing the Lincoln Co. Board of Education says a lawsuit accusing the school system of failing to adequately protect a bullied middle school student should be dismissed.

According to The Advocate Messenger, the lawsuit was filed August 10 by parents who say their daughter was bullied by other students, and that school officials didn’t take action to intercede on the girl’s behalf.  The student has been moved to Garrard Co. Schools.

Timothy Walker, the attorney for the Lincoln Co. Board of Education says claims in the lawsuit are “barred by sovereign immunity, governmental immunity, and/or official immunity,” and that the plaintiffs did not adequately go through school administration channels to rectify the problem.

The lawsuit against the school system seeks compensation for emotional distress, embarrassment, humiliation, and violations of the student’s civil rights, according to The Advocate Messenger.  Walker’s response asks for recovery of litigatory expenses.
