Lexington man accused of keeping children in dog cages appears in court on abuse charges
LEXINGTON, Ky. (ABC36 NEWS NOW) — A Lexington man accused of horrific abuse involving multiple children appeared in court Thursday, facing a series of felony charges tied to what investigators describe as extreme neglect and confinement.
Brian Smith appeared by Zoom from the Fayette County Detention Center for his arraignment. Court records show he is charged with six counts of first-degree criminal abuse. Smith waived a formal reading of the charges and entered not guilty pleas.
His case was continued to Tuesday, Feb. 10 for a preliminary hearing. If Smith is able to post bond, a judge ordered that he have no contact with Kayla Smith or the alleged victims and that he not possess any firearms.
According to a criminal complaint filed by investigators, the case came to light after two children were removed from the home and placed in foster care. The children reportedly told foster parents that they had been locked inside dog cages for extended periods of time by their biological parents.
The complaint states the children described being confined as punishment and said they were sometimes forced to remain inside the cages for hours. Investigators noted the children showed signs of physical injury, emotional trauma, and neglect consistent with the statements made during interviews.
Court documents allege the abuse occurred over an extended period while the children were living in the home.
Kayla Smith was also arrested in connection with the investigation, according to an arrest warrant filed in Fayette County. The warrant outlines allegations that she participated in or allowed the abuse to occur. Her case remains pending. She’ll appear in court next Tuesday as well.
Police and child protection officials say the children are now safe and receiving care.
The investigation is ongoing, and additional charges are possible.
