KY part of multistate settlement with children’s vitamin manufacturer
FRANKFORT, Ky. (WTVQ) – Kentucky, along with 47 other states, is a part of a settlement in a case involving civil allegations of unlawful labeling practices involving Qualitest-branded children’s multivitamin tablets with fluoride.
Kentucky’s Medicaid Program will receive just over $2,000 as part of the settlement.
Kentucky’s settlement amount was prorated among the other states and the federal government based on utilization. Kentucky’s utilization was low; therefore, Medicaid expenditures were low for this multivitamin.
According to the whistleblower lawsuit, Endo unlawfully labeled and marketed the tablets as containing the FDA-recommended amount of fluoride, when in fact the tablets contained less than half that amount.
According to the settlement, these tablets are frequently prescribed to children, and the mislabeling resulted in chronic under-dosing of supplemental fluoride, exposing recipients to a higher risk of cavities than if they had received the proper fluoride amount.
