KSP report may contradict lawsuit against Nicholasville officer killed in crash

GARRARD COUNTY, Ky. (WTVQ) – Troopers are blaming the weather for a Garrard County crash that killed a Nicholasville Police Officer and sent four people to the hospital.

Details in their investigation may contradict information from a lawsuit ABC 36 learned about on Thursday, filed by some of the crash victims.

The report says, “at the time of the collision the sun had not risen so low light conditions were a factor. Also it was reported that heavy fog was in the area.”

Just before the crash, the report says visibility dropped to 0.2 miles.

March 11, Nicholasville Police Officer Burke Rhoads was on his way to training when troopers say a car turned onto US-27 and clipped his cruiser. The cruiser then spun backwards into on-coming traffic and was hit a second time by a SUV.

A lawsuit filed by the family in the SUV claims Officer Rhoads was driving, “in a careless and reckless manner at a high rate of speed for the conditions and losing control thereof and causing a collision.”

As part of their report, KSP investigators checked the event data recorder, EDR, in the cars, essentially a little black box in a car.

According to the EDR, Officer Rhoads was going between 50-52 mph just before the crash.

The speed limit on that stretch of road is 55 mph.

The report says the SUV was going 64 mph but slowed down to 48 mph before hitting the cruiser.

Troopers blame the conditions; heavy fog and dark conditions, for the crash.
