Debate Continues as to Whether Caldwell is Fit for Trial
No trial date has been set yet for James Cardwell.
Junell Harris, the mother of the 21 year old girl Caldwell allegedly stalked, said getting justice is a drawn out process.
Police said Caldwell threatened to kill Harris’ daughter. According to police, he sent threatening letters to the young woman.
He allegedly said he thought about spraying her with gasoline and setting her on fire.
Harris said the defense wants to dismiss the charges because Caldwell wrote he thought or dreamed about it, not that he actually would do it.
The defense attorney told ABC 36 News he filed a dismissal but declined to give the reasons.
After Harris filed charges in May Caldwell went missing for about a week before he was arrested.
Caldwell has already had several mental evaluations that ruled him competent to stand trial, but the defense said they want their own expert.
Harris said Thursday was particularly hard because her lawyer said at most Caldwell will get a year sentence. That’s because if he is tried, it will be for a misdemeanor charge.
She said she was unable to file an emergency protective order because Caldwell and her daughter were not in a relationship. Had she done that, she said Caldwell could be facing 5 to 10 years of incarceration.
