UPDATE: AG pursues further action against Crestlawn Cemetery
FRANKFORT, Ky. (AP) – On Tuesday, Attorney General Andy Beshear announced that his Office of Consumer Protection has filed a motion for default judgment against Dale Shackelford and Crestlawn Cemetery in Scott Co.
Beshear’s office is asking a judge to order the defendants to fulfill all outstanding obligations to consumers or provide full refunds, properly register and pay the office civil penalties.
In late May, the Office of the Attorney General brought a civil lawsuit against Crestlawn Cemetery LLC and owner Dale Shackelford after receiving numerous consumer complaints alleging that headstones and other items had not been installed and that adequate maintenance was not being performed on the cemetery grounds.
Shackelford failed to respond to the suit prompting the Attorney General’s Office to take further action by filing a motion for default judgement.
The motion is scheduled to be heard by Scott County Circuit Court Aug. 4 at 1 p.m.

Democratic Attorney General Andy Beshear has sued the owner of a Scott County cemetery he says has failed to install grave markers despite taking thousands of dollars from customers.
Beshear said he filed the lawsuit Tuesday against Dale Shackelford, owner of the Crestlawn Cemetery in Georgetown. Beshear said at least 20 people have complained to his office about the cemetery. He is asking a state judge to order Shackelford to install the markers or refund the money. He is also seeking civil penalties of up to $2,000 per violation.
It is unclear if Shackelford has an attorney. Calls to several phone numbers listed for him were not returned.
Betty Fain said she paid Shackelford more than $2,600 for a marker that included a plaque from the Navy. She said neither has been installed.
