Louisville woman charged in infant’s death takes plea deal
LOUISVILLE, Ky. (AP) – A murder charge against a Louisville woman accused in the 2011 death of her infant daughter has been dropped as part of a plea agreement.
The Courier-Journal reports (http://cjky.it/1UcaoQ4 ) Assistant Commonwealth’s Attorney Chris Foster agreed to drop the murder charge against 26-year-old Whitney Phillips in a plea agreement reached Wednesday.
Phillips was first charged with complicity to murder in 2013 in the death of 7-month-old Ariah Phillips. The infant was found unresponsive in her home in February 2011 and pronounced dead.
Foster also amended three counts of criminal abuse from first-to second-degree in exchange for Whitey Phillips’ plea. Her sentencing is set for Feb. 9.
In September, Phillips’ former boyfriend, James McElroy pleaded guilty to murder in the child’s death and is serving a 20 year sentence in the case.
