Case against man charged in toddler’s overdose death goes to grand jury

LEXINGTON, Ky. (ABC36 NEWS NOW) — New developments in the case against a man accused in the overdose death of 18-month-old Cho’zyn Wilson in Lexington — as the case is now moving forward to a grand jury.

According to court proceedings Friday, Ka’Darrius Warren appeared for his scheduled preliminary hearing. Following the hearing, the case was waived to the grand jury for further consideration.

Warren is charged with murder in connection with a 2022 overdose death, according to court records.

Background of the case

As previously reported, Warren initially refused to appear from the Fayette County Detention Center during a February 5 court appearance, when a judge set his bond at $1 million full cash and scheduled Friday’s preliminary hearing.

Investigators say the case began in August 2022, when Lexington Police Department officers were called to a home on Charles Avenue for an unresponsive toddler. The child was taken to a hospital but later died.

An autopsy found lethal levels of fentanyl and acetylfentanyl in the Cho’zyn’s system, and the death was ruled an overdose.

According to criminal complaints and arrest documents, investigators used phone records and witness statements to place Warren at the home in the hours before the child’s death. Authorities allege narcotics were used in the room where the child was present, leading to the fatal overdose.

The case remains under investigation as it moves through the court process.
