New court filings released in case of former Letcher County sheriff charged with judge’s shooting death
WHITESBURG, Ky. (ABC36 NEWS NOW) – Newly filed court documents shed light on the ongoing case against former Letcher County sheriff Shawn “Mickey” Stines, who is charged with murder in the September 2024 shooting death of Judge Kevin Mullins.
Defense motions and arguments
Attorneys for Stines filed multiple motions, including a Motion to Dismiss the Indictment, arguing that prosecutors mishandled aspects of the grand jury process and that Stines’ constitutional rights were violated. While portions of that motion have been sealed by court order, the public filings challenge the sufficiency of the evidence and allege procedural issues in how the case has advanced.
The defense also submitted a Motion for Bond, stating Stines should be released on conditions, arguing he is not a flight risk and has longstanding ties to the community. Prosecutors oppose bond, citing the seriousness of the charges.
Commonwealth requests venue change
The Commonwealth’s Attorney has filed a motion to move the trial out of Letcher County, citing extensive media coverage and arguing it would be difficult to seat an impartial jury. Stines’ defense team responded with a filing opposing that request, saying the case should remain in the community where it occurred.
Prosecutors also filed a motion to unseal portions of the case record that had previously been restricted, as well as notices related to examinations of witnesses.
