Man accused of being asleep while his children played near highway

MANCHESTER, Ky. (WTVQ) – Social Services took custody of three small children whose father was taken into custody by deputies in Clay County.

Investigators say around 10:30 a.m. Friday, they responded to a report of small children playing next to North Highway 421 without any supervision.

Deputies say when they arrived, they found 30-year old James Emery asleep in his home.  Investigators say Emery didn’t know his children were outside alone.

He was arrested and charged with three counts of child welfare endangerment, according to deputies.

Investigators also noted the living conditions in Emery’s apartment were unfit for children.
