Man wounded by deputy files federal lawsuit

ELIZABETHTOWN, Ky. (AP) – A man shot by a Kentucky deputy during a traffic stop has filed a federal lawsuit against the former law enforcement officer and a sheriff.

The News-Enterprise reports attorneys for Michael Williams filed suit Wednesday against Hardin County Sheriff John Ward and former deputy Clennon Smith. The suit says Ward should not have hired or retained Smith due to three previous incidents described as “excessive force.”

Ward and Hardin County Attorney Jenny Oldham declined to comment on the allegations.

Williams was shot last February and the lawsuit says he was permanently disfigured. The lawsuit says Smith fired as Williams began to lower his hands. Williams wasn’t armed.

A Hardin County grand jury declined in August to indict Smith on criminal charges. The deputy resigned Oct. 15 from the sheriff’s office.
