COVINGTON, Ky. (AP) – Prosecutors are appealing the reversal of a Kentucky doctor’s health care fraud conviction.
The Daily Independent (http://bit.ly/2o2USOW) reports prosecutors filed the appeal Tuesday in Ashland cardiologist Dr. Richard E. Paulus’ case.
A jury in October had convicted Paulus on charges of health care fraud and making false statements relating to health care matters.
However, a federal judge last month dismissed all 11 counts against him, saying prosecutors didn’t prove beyond a reasonable doubt that Paulus had “acted with fraudulent intent.”
Paulus was accused of performing unnecessary heart procedures on dozens of patients and falsifying records over a five-year period to make it appear that the procedures were necessary before billing Medicare, Medicaid and other insurers.
The U.S. Attorney’s office declined comment. Paulus’ attorney Robert Bennett wasn’t immediately available for comment.
