According to the prosecution, Smith had the victim, Patty Smallwood, and others drive across state lines to get prescriptions for oxycodone. When they returned, prosecutors say Smith paid them to have the prescriptions filled at pharmacies in Manchester, Kentucky. The individuals then gave the pills to Smith who kept some, and split the rest with the others. Evidence at the trial showed that Smallwood took the pills that evening, went to sleep, and never woke up. A toxicologist testified that an oxycodone overdose was likely the cause of Smallwood’s death.
Terry Smith faces a mandatory minimum of 20 years in prison for the conviction. His sentencing is scheduled for may 15, 2015.
