Wolfe County Deputy Marcus Stephens was just finishing his shift  around 2:30 in the morning on January 13th when he got a call about a domestic disturbance.

Little did he know he'd soon find himself with another man's life literally in his hands.

Police say Jonathan Burke  was intoxicated at the time, holding a pistol and causing the disturbance.

When Stephens arrived at the scene Burke was gone.

While talking to his family, Stephens says a gun shot was heard down the road near the creek.

Stephens, following the sound of the gun shot, would find Burke face down in the water unconscious  and drowning.

Burke would pull through, his family says Stephens is a hero.

Despite the danger police say Burke caused with the gun, Stephens says he didn't even think twice about saving the man's life.

Burke declined to comment on this story.

He does not face any charges, and his family says he doesn't even remember that night.

Stephens says he hasn't heard from Burke since the incident.
