22-year-old Robert Miller was arrested on New Year's Eve by a Pulaski County deputy, who realized Miller was wanted on an outstanding warrant.

In October, the Somerset-Pulaski County EMS answered a call at Bob Evans restaurant, where they were told a two-year-old boy was not responsive.

The toddler was airlifted to UK Hospital, where medical staff discovered the child had a brain injury due to blunt force trauma.

The statements Miller gave to hospital staff did not match the examination of the child's injuries.

Police determined that Miller was the only adult guardian present when the toddler was hurt. According to officers, when the child lost consciousness, Miller drove him to Bob Evans, where the toddler's mother was working.

Miller was charged with assault and criminal abuse.

He is in the Pulaski County Detention Center on a $100,000 cash bond.
