State Police say the initial autopsy report on 50-year old Kenneth Payton shows he died prior to the fire that destroyed his house.

Investigators say they are now ruling the case a murder.

Police did take Aaron Spencer into custody and has charged him with arson in the case after investigators say accelerants were used to start the fire.

Family of Payton say they did not know Spencer, and say he was not Payton's roommate.

KSP says no one has been charged with the murder of Payton, and did not say if they are looking for any other suspects in the case at this time.

Payton's girlfriend Pamela Cantor was also taken into custody, but for an outstanding warrant, unrelated to this case.

The investigation is still on going.
