The track says wagering since then has totaled 40 million dollars.

Today the Kentucky Horse Racing Commission gave the okay for another 75 machines for the track.

The Family Foundation has sued over 'instant racing' saying current state laws don't allow it.

That suit is still making its way through the courts.
