A mother who says she almost witnessed her daughter abducted is speaking out tonight, outraged the two men who tried to kidnap her daughter were found, and not being charged with anything.

According to Kentucky Law, if someone is only talking to a child and asking them to get in their car, with no physical contact, then it is not attempted kidnapping.

The mom wished to remain anonymous, but told ABC 36 her daughter and friend were riding their bikes not far from their home, when two men in a black mini-van pulled up in front of the girls and asked "are you lost" and if they wanted a ride in the van.

The girls said 'no' and ran back home.

Someone had written down the license plate of the van and reported it to police.

Police found the two men, interviewed them and then let them go with no charges.

The mother says her family is in the process of contacting Commonwealth's Attorney Ray Larson to see if any changes can be made to the law.

The two men are described as white and in their late 40's, driving a black mini-van, a Kia model.
