A Lexington father who was charged with manslaughter in the death of his two year old daughter will not be indicted.

The grand jury has refused to indict Jackson McReynolds.

Police said his daughter Addy was on a seat on the front deck of the mower back in May. The seat was not attached to the mower.

When the lawnmower made a sharp turn, Addy fell off and was run over. The state medical examiner says McReynolds' blood alcohol level was above the legal limit at the time of the accident. Police say McReynolds had two drinks before he left work, and officers said they could smell alcohol on his breath.
