The use of the red wax seal on Maker's Mark bottles is going before a panel of federal judges Thursday.

The US 6th Circuit Court of Appeals is stepping into the arguments over whether Maker's Mark can keep the trademark on their red cap or if other liquor companies can use a similar seal.

Maker's Mark won an order awarding it exclusive rights to the seal last year.

They are trying to stop a London based company that is using a red wax seal on its tequila.
